THIRD-PARTY SERVICE PROVIDERS

1.Third-Party applications are inherently used by Quick123Sites for the purpose of rendering provided services and maintaining the functionality of our site, including but not limited to: "Google Email", "Google Forms", "Wix Apps", "Pay-Pal" including any and all other applications used on our website. Setting up a requested associated Social-Networking Accounts with Twitter, FaceBook or user requested Third-Party applications on your Quick123Site to include but not limited to: Hit Counters, Maps or any and all other Third-Party Service Provider Applications are used in and for this process.

1.Quick123Sites does not maintain, sponsor or own the websites or links connected to this website linking to outbound websites. Any such use of website links are at the discretion and responsibility of the user. Quick123Sites absolves all responsibility for any impairment, damage or loss of use of any and all electronic devices used to access such links.

LAWFUL COMPLIANCE OBLIGATIONS

1. Quick123Sites is legally obligated to cooperate and comply with the law and lawful orders. Therefore, compliance of disclosure of user personal information, usage data, or any other information about you, if legally required (either by subpoena, court order or investigation) to satisfy enforceable laws or investigation of potential violations, fraud, security or protect against harm to the rights, property or safety of the Quick123Sites its users or the public, as required or permitted by law, will be adhered to.

USER DATA AND LEGAL COMPLIANCE

1.Upon submitting or transmitting any and all information necessary for the utilization of Quck123Sites and or its "Services", including but not limited to "User" [Name/ Email/ Phone Number/ Images/ Videos/ Social Media Links/ Account Links/ Intellectual Property], the "User" is fully indicating by submission:

* Exclusive-Ownership and/or has the proper licenses or consents to use the data.

* User is legally authorized to represent the exclusive-owner of the data.

* User agrees that Quick123Sites will not be at risk of infringing any intellectual property rights or third parties.

* That "User's" submitted or transmitted data fully complies with the law.

* Agrees that Quick123Sites will not be liable whatsoever for the user’s misuse of its data.

* That Quick123Sites declares the right to revoke or restrict the user’s access to its website, products, or services in the event
that the user violates the Terms and Conditions or any applicable law.

* That Quick1253Sites reserves the right to refuse use of any submitted or transmitted data, if in the discretion of

USE OF THIRD-PARTY SERVICE PROVIDERS

1.Upon utilizing Quick123Sites Services, you are agreeing and consenting to our use of Third-Party Service providers and applications in conjunction with the creation of your Quick123Site. Since Third-Party applications are inherently used by Quick123Sites for the purpose of building and maintaining the functionality of your site, including but not limited to: "Third-Party Apps", including any and all other applications used on your website or social media accounts, Quick123Sites absolves all responsibility for maintaining the functionality, operability, security, and or any other relative issues that may arise from using any and all Third-Party Service providers and applications. As such, "you" the "user" agrees not to hold Quick123Sites responsible for any technical or legal issues related to the use of Third-Party Service providers and applications in connection to your Quick123Site and or social media accounts.

2. Quick123Sites is not an affiliate nor a sponsor of any Third-Party Service provider or application used on your Quick123Site, or in the creation of your Quick123Site and or social media accounts.

HOW WE DO WHAT WE DO

1. Quick123Sites's interest is in assisting you in building a Basic Website, at the least cost and time to you, so that your service, business or interest, can enter the world-wide-web with its feet "running" (so-to-speak). However, In order for us to save you Hundreds or even Thousands of dollars, we cannot require of you to purchase a Domain Name or Purchase a Web-Hosting Service Plan as our competitors require of you.

2. So how do we work around this issue? Simple... We assist you in building a basic website through your filled out "Questionnaire" "Collaboration Phone Calls" or "Collaboration Emails" then publish your site to the world-wide-web using a "Sub-Domain" which still provides you the opportunity to "Name your site" what ever you choose (so long as it's available), and attach that "Name" as a "suffix", to the URL Address.

3. The Prefix to your URL Address will typically be the name of the email account you create, or authorize Quick123Sites to create upon using our services that create your site, followed by the web-hosting service as a ".com", finally followed by the "Name" you chose for your site. For example, when we create your site, if you choose to name your site "Cookies" or "CookieCrumbles" (and the name is available), Your URL Address will then look something like this...

4. Upon our completing your site, we will then transfer the completed site over to you, which at that point, you can then change the password that accesses your site and site email account, ultimately concluding our service.

5. You can then place your Site-Link on your Social Media accounts, YouTube Channel, Business Cards, Send Via-Text, Send Via-Email, etc...

6. And if you would like to Purchase a Domain Name and or Web-Hosting Plan in the future, for your new site, and would like assistance with that, we can assist you in completing that process.

7. And if you would like us to assist you in "Editing" your site in the future as-well, again, please take advantage of our "Editing Offer" and we will be sure to assist you with that future service as-well.

8. Finally, one of the great advantages you will have after utilizing Quick123Sites service of building you a website of your own, is that you will have complete access and ability to update your site on your own at anytime if you choose after it's published.

We can help! But because we don't charge you for a Web-Hosting Plan and Domain Name, which is generally used to "Sell Online", our Quick123Sites Representative will give you a few other options to choose from. Just be sure ask for this assistance during your "Collaboration Phone-Call".

1. Quick123Sites may offer to build a client a FREE SAMPLE WEBSITE of their Business to assist them in their decision to proceed. The SAMPLE WEBSITE may only be published for 24 hours to assist in giving the client an idea of what their Quick123Site may look like. After the client's review, the client may proceed to complete the purchase of Quick123Sites services in building them a Quick123Site / or / If the client would like to request further Modifications Prior to completing the final purchase of Quick123Sites services, the client must complete a Non-Refundable Modification Purchase Fee of $50. If the client chooses to proceed to the final purchase after reviewing their requested Modification, the $50 Fee will be applied to their final purchase.

USE OF QUESTIONNAIRE/SERVICES

1. Upon utilizing Quick123Sites services, you understand and agree the contents of the submitted Questionnaire will be transmitted into its perspective page, in proportion to the dimensions allotted in requested package details.

1. Quick123Sites offers user's assistance in building a website of their own upon purchasing a #1 BASIC PACKAGE. This offer consists of: 1 Home Page; 1 Free page; 1 About Page; 1 Contact Page, with an approximate size of 1350px wide by 768px high, for each web-page, which "may" be more or less depending on the content. Any submitted data/content, i.e. images, videos, text, etc... "shall" be restricted to the available space within the approximate page dimensions.

2. Once the client has requested the #1 BASIC PACKAGE and/or by Filling out the "Questionnaire" and submitting it via email by clicking the "SEND BUTTON" at the bottom of the Questionnaire, the user will then receive their "First-Collaboration Phone Call" from a Quick123Site Representative at the time requested placed in the Questionnaire, to "Confirm Submission" and "Collaborate" with the user regarding the details of their request. If for what ever reason "You" could not meet the scheduled First-Collaboration Phone Call, a last second attempt will be made by the representative sending out 1 last email, again requesting the best time for a representative to call.

3. Upon completion of this "First-Collaboration Phone Call", the user will receive an email by their Quick123Sites Representative, which will contain a LINK to follow where they can then complete their PURCHASE and submit any "Images" vie email response. Payment Plan

PARTIAL-PAYMENT-PLAN:

1. Quick123Sites offers a Partial-Payment-Plan to Approved-Customers to assist them with Payment for services during the current Covid-19 Pandemic. Request must be made by the customer to their Quick123Site Representative at the time of their First Collaboration Phone Call. Once Approved by Quick123Sites, the customer will receive an email confirming their request and agreement to make a Partial-Payment equaling "Half" of the requested service price. This Partial-Payment will be counted toward Payment for Development, Publishing and Connectivity of the customers new Quick123Site for a limited time.

2. Arrangements for the Final-Payment equaling the remaining Half of the requested service price will be made via the customers next Collaboration-Phone Call/ Email for the Final-Payment to occur within 10-dys of the Partial-Payment.

3. If for what ever reason the Final-Payment is not made within 10 dys of the Partial-Payment, Quick123Sites"may" Unpublish the clients Quick123Site till the Final-Payment is received, not to exceed 20-days from the first Partial-Payment date. After 20-days of the Partial-Payment, if the Final-Payment is not received, Quick123Sites "Shall" conclude all services and business with the delinquent account holder/customer and retain the Partial-Payment as payment rendered for the Development, Publishing and Connectivity of Services of their Quick123Site as described in paragraph 1. under this PARTIAL-PAYMENT-PLAN section. At which time, any new service requested by said customer would require starting from STEP-1 as an entirely new customer with no prior payment accredited to the new service. Final publication of developed websites are subject to the completion of the final Payment.

4. Any and all re-connection of services or re-publishing of the customer's Quick123Site will require a $65 Fee in addition to any other required services.

TIME LIMITS OF ACCEPTING TRANSFER OF WEBSITE:

It is important for the client to take ownership of their transferred website within 72hrs to avoid having the website deleted. Please read the following as it pertains to taking ownership of transferred websites.

1. Quick123Sites aim is to accomplish our services in a practical and timely fashion. The aim of completion is typically no longer than 2 Weeks. This inherently includes the process of the client, taking ownership of the developed website via the instructions of the Quick123Sites Representative after it's been transferred to the receiving email address that either the client or Quick123Sites created or email address on file. The complete process of the client taking ownership of their newly developed website should generally take no longer than 48hrs after its transfer.

It is also the responsibility of the Client to examine their newly built Website to ensure all information associated with their site is correct 'prior' to the completion of services, as any modification required or requested after completion will require a purchase of service.

2. If for whatever reason the client has not taken ownership after 48hrs, Quick123Sites will attempt to assist the client in taking ownership via Collaboration Phone Call or Email-Instructions.

3. If the client still has not taken ownership after attempts have been made to assist the client, and the website was transferred to a client created email address or email on file:

a. Quick123Sites absolves all responsibility related to the transferred website as Quick123Sites does not maintain a database to house completed or transferred websites and is not responsible for maintaining it's Published Status after completion or transfer.

4. If the client still has not taken ownership after attempts have been made to assist the client, and the website was transferred to a Quick123Site created email address as stated in HOW WE DO WHAT WE DO par. 3:

a. Quick123Sites may delete the created email address and Re-Transfer Ownership of the client's developed website to the clients email on file, at which time Quick123Sites absolves all responsibility related to the transferred website as Quick123Sites does not maintain a database to house completed or transferred websites and is not responsible for maintaining it's Published Status after completion or transfer.

5. If after these Good-Faith Efforts by Quick123Sites, the client still does not take ownership of their transferred website , the client risks having said website deleted, as Quick123Sites does not maintain a database to house completed or transferred websites. Quick123Sites will consider services rendered and completed in good-faith and there "Shall" be No Refunds.

6. If the client did not take ownership of their website within the 72hrs timeframe and their website was deleted as a result, a $50 Recovery Fee will be required for "Recoverable" websites. Note: Not all websites are recoverable.

30 Day Surcharge

Quick123Sites aims to complete all services within 2 Weeks/ 30 Day Max-Period excluding extenuating circumstances. For Quick123Sites completed within the 30 Day-Period, if it is determined by the Client for their completed Website to remain on the Quick123Sites Web-Development Database for what ever reason, a required fee of $29.99 Surcharge must be completed Per-Month by the Client to avoid the risk of their Website automatically being deleted as Quick123Sites does not maintain a database to house completed or transferred websites.

NOTE: surcharge fee applicable within 30 day period only; regular service prices applicable thereafter.

VIP Service Plan

VIP Service Plan / Web-Hosting & Domain Name Connectivity Services

1. For the purpose of providing our Valued Clients the most effective marketing tools and services available, Effective Jan 1, 2023 Quick123Sites will offer a "VIP Service Plan" which includes Third-Party Web-Hosting & Domain Name Connectivity Services. Upon upgrading from a #1Basic Package or #2Premium Package which did not require the purchase of a Web-Hosting or Domain Name Plan to a "VIP Service Plan", Valued Clients can now have Web-Hosting and Domain Name services connected.

2.Upon purchasing the "VIP Services Plan" Clients will receive:

*"Domain-Name Connectivity Service" from a provided list of Domain-Names applicable to the Business Name or Service.
*"Web-Hosting Connectivity Service".
* Full-Time access to Web-Developer Mon-Fri 8am-5pm (PST).
*50% Discount on all future website Editing Services.
*Monthly Website Assessment.
*Updated Website Content Management

3. Connectivity Services: Domain Name/s and Web-Hosting Connectivity Services are completed when the client agrees to authorize Quick123Sites to secure the domain name/s and hosting service as the Third-Party and registrant, on behalf of the client for the sole purpose of providing Connectivity Services in conjunction with par.3 of HOW WE DO WHAT WE DO. As such, the "Client" is the Legal-Owner of the domain and absolves Quick123Sites from any and all legalities associated with the domain and or hosting service.

4. Security of Client Domain and Web-Hosting Services: Quick123Sites secures clients Domain Name/s and Web-Hosting Services in several ways. Functioning as a Third-Party for purposes described in paragraph 3 of this section, Quick123Sites prevents unauthorized access to, or exploiting of vulnerability in the domain name registrar's system by securing and limiting access into account/s associated with the domain name registration and web-hosting services accounts.

5. Upon using Quick123Sites Third-Party domain name and web-hosting connectivity services, clients consent to the management of associated accounts and clients may request the transfer of their domain 90 days after the purchase of their domain (restricted to same registrar). Subject to the transfer, Quick123Sites shall close any and all existing web-hosting accounts prior to transfer for security purposes. Any and all time left remaining in the closed web-hosting account and or associated costs shall not be refunded, returned or recouped by client.

6. Any and all services not specified in this section are subject to additional fees. The retention of Website Manager's are discontinued upon the requested cancellation of any services associated with the VIP SERVICE PLAN by the Valued Client.Quick123Sites "shall" retain any prior payments made by deeming prior payments rendered for the initial connectivity and services rendered.. There "shall" be No-Refunds.

7. Upon agreeing to these Terms and Conditions in this section, client may proceed to purchase VIP Service Plan / Web-Hosting & Domain Name Connectivity Services

8. Business Email Accounts shall be seperate offers from Web-Development Packages and VIP Plans and are priced at $12.99 per month and require a #3 Editing Purchase for initial technical assistance set up. Business Emails must be requested by client and require 24-48 hours for set up.

CANCELLATION POLICY

1. Website Development; Upon utilizing Quick123Sites services in the development of "Client" website in conjunction with a completed purchase, "Clients" may cancel further development of their website within 24hrs of the service purchase date. Any and all requested cancellations of the website/s development must be completed via-email from the client directly to their Web-Developer's Email Address /or/ quick123sites+cancellation@gmail.com.

2. Web-Hosting & Domain Name Connectivity Services; Upon utilizing Quick123Sites Web-Hosting & Domain Name Connectivity Services in conjunction with a completed purchase, "Clients" may cancel either service independently from the other at any point in time during the life-time of the services. However, due to the interconnectivity between the domain name and web-hosting service, if a client opts to cancel either service, such cancellation will inherently remove accessibility of the developed website from the internet. Any and all requested cancellations of either service must be completed via-email from the client directly to their Web-Developer's Email Address /or/ quick123sites+cancellation@gmail.com.

3. Domain Name; If a client opts to cancel their connected domain name service at any point in time during the life-time of the service, access to the website the domain name was registered to will become deactivated causing any and all data associated with that domain name to be removed from our system. If a client opts to cancel their connected domain name for any other reason, the client must notify Quick123Sites via-email to quick123sites+cancellation@gmail.com prior to cancellation. Quick123Sites "shall" not transfer the domain name outside of the web-hosting platform the domain name was initially hosted on. Any and all requested cancellations of this service must be completed via-email from the client directly to their Web-Developer's Email Address /or/ quick123sites+cancellation@gmail.com. Upon cancellation, Quick123Sites "shall" retain any prior payments made by deeming prior payments rendered for the initial connectivity of this service. There "shall" be No-Refunds.

4. Hosting Service; If a client opts to cancel their connected web-hosting service at any point in time during the life-time of the service, access to the website that was being hosted will become deactivated causing any and all data associated with that website to be removed from our system. If a client opts to cancel their connected hosting service for any other reason, the client must notify Quick123Sites via-email to quick123sites+cancellation@gmail.com prior to cancellation. Any and all requested cancellations of this service must be completed via-email from the client directly to their Web-Developer's Email Address /or/ quick123sites+cancellation@gmail.com. Upon cancellation, Quick123Sites "shall" retain any prior payments made by deeming prior payments rendered for the initial connectivity of this service. There "shall" be No-Refunds.

Renwals

VIP SERVICE RENEWALS:

1. Upon clients renewal of their yearly VIP SERVICE subcription, client may receive:

*Extended "Domain-Name Connectivity Service" for the duration of the renewal period or (1 Year).

*Extended "Web-Hosting Connectivity Service".for the duration of the renewal period or (1 Year).

*Extended "Full-Time access to Web-Developer Mon-Fri 8am-5pm (PST) for the duration of the renewal period or (1 Year).

*Extended "50% Discount on all future website Editing Services for the duration of the renewal period or (1 Year).

*Extended "Monthly Website Assessment for the duration of the renewal period or (1 Year).

2. Upon clients renewal of their yearly subcription, client agrees to extend authorization as described in Paragraphs 3-7 under subheading: VIP Service Plan / Web-Hosting & Domain Name Connectivity Services; to Quick123Sites.

3. Security: In addition to Paragraph 2 of this section, client also agrees for Quick123Sites to "secure" previously transfered website/s as discribed under suibheading:TIME LIMITS OF ACCEPTING TRANSFER OF WEBSITE:;for security of account purposes. As such, the "Client" is the Legal-Owner of the domain and absolves Quick123Sites from any and all legalities associated with the domain / hosting service and or contents of website.

All Holiday Webcards will additionally become inactive and deleted from Quick123Sites data base the day following said holiday.
